1. TERMS

1.1. This document constitutes the Terms of Service ("Terms") between you, the end-user, and MikoAI ("Company", "we", "us", or "our") governing your use of the MikoAI mobile application (the "App") and all related services (collectively, the "Service"). 'MikoAI' refers to the App and the Service for the remainder of this document.

1.2. By downloading, installing, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are using the Service on behalf of an entity, you represent that you have the authority to bind that entity to these Terms.

1.3. If you do not agree to all of these Terms, you must not download, install, access, or use the Service, and you must delete the App from your device.

2. ACCOUNTS AND SERVICES

2.1. An account ("Account") is required to access the core AI image generation and editing functionalities of MikoAI.

2.2. You must be at least 18 years of age and capable of forming a binding legal contract to use the Service. By creating an Account, you represent and warrant that you meet these eligibility requirements.

2.3. You are solely responsible for maintaining the confidentiality of your Account login credentials. You may not share your Account with any other person or entity, nor transfer your Account to another party.

2.4. You are solely responsible for all activities and actions conducted through your Account, whether authorized by you or not. You must ensure all such activities comply with these Terms.

2.5. We reserve the right to suspend, disable, or terminate your Account at any time, for any or no reason, including if we determine, in our sole discretion, that you have violated these Terms.

2.6. Termination of your Account will result in the loss of access to the Service and any data, content, or credits associated with your Account. We make no guarantee regarding the future availability of your data post-termination, and no refunds for purchases or subscriptions will be provided except as expressly required by applicable law.

3. PURCHASES, SUBSCRIPTIONS, AND CREDITS

3.1. The Service may offer premium features accessible through one-time purchases, subscriptions, or the use of virtual credits ("Credits"). Subscriptions grant access to "Premium Services" for the duration of the active subscription period.

3.2. Credits purchased are a virtual currency that can be used solely within the Service for designated functions, such as generating images or accessing certain AI models.

3.3. Credits are not redeemable for cash, have no monetary value, and cannot be transferred, sold, or exchanged for other goods or services outside the Service.

3.4. All sales and subscriptions are final and non-refundable, except as otherwise mandated by the laws of your jurisdiction. Repeated or abusive refund requests may result in Account termination at our sole discretion.

3.5. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Payment will be charged to your Google Play Account upon confirmation. Manage subscriptions and turn off auto-renewal via your Google Play Account settings.

4. GENERATED CONTENT

4.1. You retain ownership of the images you generate using the Service. MikoAI makes no claim of ownership or copyright over your AI-generated content. You are free to use such content, subject to these Terms and applicable law.

4.2. AI MODEL OUTPUT IS INHERENTLY UNPREDICTABLE. WE DO NOT GUARANTEE THAT OUTPUT WILL MATCH YOUR TEXT PROMPTS, BE OF A SPECIFIC QUALITY, OR BE FREE FROM ERRORS, ARTIFACTS, OR UNEXPECTED CONTENT.

4.3. You must not use the Service to generate content that is illegal under the laws of your jurisdiction, including but not limited to content that infringes intellectual property rights, promotes violence, or constitutes harassment.

4.4. You must not use the Service to generate content intended to substitute for professional advice (e.g., legal, medical, financial) or to engage in any licensed profession without proper credentials.

5. USER CONTENT AND CONDUCT

5.1. "User Content" means any content you upload, post, transmit, or make available on or through the Service. You are solely responsible for your User Content and the consequences of sharing it.

5.2. You represent and warrant that you own or have the necessary rights, licenses, and permissions to use and authorize us to use your User Content as contemplated by these Terms.

5.3. You agree not to upload, post, or generate User Content that:

• Is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of privacy, or otherwise objectionable.
• Infringes any patent, trademark, trade secret, copyright, or other intellectual or proprietary right.
• Contains unauthorized advertising, promotional materials, "junk mail," "spam," or any other form of solicitation.
• Contains software viruses or any other code designed to interrupt, destroy, or limit the functionality of any software or hardware.
• Impersonates any person or entity, or falsely states your affiliation with a person or entity.

6. INTELLECTUAL PROPERTY RIGHTS & DMCA POLICY

6.1. We respect the intellectual property rights of others and expect our users to do the same. It is our policy to respond to clear notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act ("DMCA").

6.2. To report copyright infringement, please contact us at support@exploredreamai.com with the required information as outlined in the DMCA.

7. DISCLAIMER OF WARRANTIES; "AS IS" AND "AS AVAILABLE"

8. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MikoAI, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

9. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless MikoAI and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses.

10. DISPUTE RESOLUTION; ARBITRATION; NO CLASS ACTIONS

10.1. These Terms shall be governed and construed in accordance with the laws of Hong Kong, without regard to its conflict of law provisions.

10.2. Except for disputes that qualify for small claims court or injunctive relief related to intellectual property infringement, any dispute arising from or relating to these Terms or the Service shall be finally settled by binding arbitration.

BY USING THE MikoAI SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE.
